EXHIBIT C - Pre-mining and Mining Plan Map(s) of Affected Lands (Rule 6.4.3): Please clearly show the <br />additional 9.92 acres of affected land that will be added to the existing permit area via this amendment on the <br />Mining Plan map. <br />EXHIBIT D - Mining Plan (Rule 6.4.4): Please describe the construction of, and show the proposed <br />configuration of the "outlet structures" that are intended to convey the captured flow of Vendette Creek from Cell <br />3, through Cells 4, and 5 and into Maryland Creek. Please also show how it has been determined that these <br />structures, as well as Maryland Creek will allow adequate flow to prevent adverse effects from the capture and <br />re-routing of Vendette Creek during a 100 year peak-flow event. <br />EXHIBIT E - Reclamation Plan (Rule 6.4.5): The current reclamation plan states on the first page that <br />"between 6 and 12 inches of overburden and topsoil will be placed on the Lakeshore slopes above the waterline" <br />Please remove the above referenced statement from the first page of the reclamation plan. Topsoil should be <br />handled separately from the overburden used to backfill slopes. The "Topsoiling" paragraph on the second page <br />contains a more appropriate description of how the topsoil should be handled and replaced. Because the site <br />would be expected to have a surplus of topsoil available for reclamation, the Division recommends that 8 to 12 <br />inches of topsoil be replaced in areas that will be reclaimed as rangeland. It has been observed that this will lead <br />to much greater chances of success in reclamation vegetation. <br />The operator must commit to not disturbing jurisdictional wetlands until an appropriate Wetland Mitigation Plan <br />has been approved by the Army Corps of Engineers and evidence of this approval has been submitted to DRMS. <br />DRMS will be required to add this condition as a stipulation to the amendment approval if this commitment is <br />not made during the adequacy process. Costs for implementation of the required wetland mitigation will need to <br />be included in a revised reclamation cost estimate in Exhibit L and broken down as such. <br />EXHIBIT F - Reclamation Plan Map (Rule 6.4.6): Please add the outflow structures to carry the flow of <br />Vendette Creek to the Reclamation Plan Map. <br />EXHIBIT G - Water Information (Rule 6.4.7): Adequate as submitted <br />EXHIBIT H - Wildlife Information (Rule 6.4.8): Adequate as submitted <br />EXHIBIT I - Soils Information (Rule 6.4.9): Adequate as submitted <br />EXHIBIT J - Vegetation Information (Rule 6.4.10): Adequate as submitted <br />EXHIBIT K - Climate (Rule 6.4.11): Adequate as submitted <br />EXHIBIT L - Reclamation Costs (Rule 6.4.12): All information necessary to calculate the costs of reclamation <br />must be submitted and broken down into the various major phases of reclamation. You must provide sufficient <br />information to calculate the cost of reclamation that would be incurred by the state. The provided addition of <br />3.45% to the existing estimate is insufficient, especially considering the current age of the original reclamation <br />estimate. <br />In addition to the above costs, the following text is taken from the Division of Water Resources General <br />Guidelines for Substitute Water Supply Plans for Sand and Gravel Pits. <br />"If the proposed final reclamation of the mining operation, as approved in the DRMS permit, does not <br />include backfilling or lining to eliminate all ground water exposed within the mining boundaries,
