Cattany <br />Division Director <br />Natural Resource Trustee <br />Re: Topaz Mine, Permit No. M-1980-055 HR, Temporary Cessation (Revision TC-1), Review Letter. <br />Dear Ms. Woodward, <br />On February 8, 2010, this office found your request to revise the permit status of the Topaz Mine to <br />temporary cessation (TC) complete. The request stated that temporary cessation began at this site on July 31, <br />2009. <br />Per Hard Rock/Metals Rule 1. 13, certain onsite activities that might occur in the permitted area are not <br />considered to be mining. According to the recent annual report, some of these non-mining activities possibly <br />occurred after July 31, 2009, including monitoring and treating noxious weeds, and stormwater management <br />inspections. Those activities still allow the site to be considered "inactive." No reclamation was reported to <br />occur at the site after that date. However, please be aware that any reclamation, additional stockpiling, <br />facility construction (including an ore pad liner) are considered mining activities, and the period of TC would <br />end. Denison should notify this office of that date. New period of inactivity could begin, and another five- <br />year period of TC would begin anew. <br />Temporary cessation may be approved for a site if it can be ensured that the operator will monitor and <br />maintain the site in a stable condition. Given the variety of structures and features on the site, this office <br />must confirm that they are, in fact, currently stable and will be maintained thus throughout the period of <br />temporary cessation. Please confirm, therefore, that the following items are stable and/or secure: topsoil <br />stockpile, portal entry, buildings, storage tanks, and electrical supply structures. <br />Since this site also operates under a BLM Plan of Operations, please state whether there will be any ongoing <br />BLM-required activities that may constitute "mining." <br />There is no revision of the bond amount anticipated as part of this revision of permit status. <br />The decision date of this revision is set for March 10, 2010. Please respond to the items above before that <br />date. If additional time is needed to prepare and submit responses, please send me a request to extend the <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
