III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Janet Binns and Rob Zuber of CDRMS. The mine no longer extracts coal,but <br /> the remaining surface pit(Pit B)is permitted to dispose of flyash. The weather was cool and calm. The mine site was damp <br /> with small patches of snow throughout the site. Present at the inspection were Don MacDonald and Danny Kipp of Coors <br /> Energy Company. <br /> Records were inspected and found complete and up to date. CEC provided the 2009 Annual Reort and aerial photo to the <br /> inspector during the inspection. <br /> Roads: CEC continues to remove road base material from the haul road return from the pit to the facilities.A portion of the <br /> base of the haul road has been ripped. The main haul road to the pit has recently been regarded. Road side ditches along the <br /> haul road are in good shape. The access and haul road are in good condition and well graded. <br /> Hydrologic Balance: Pond#2 was dry with patches of snow. The Dugout pond was also dry. Pit B was dry with infrequent <br /> snow patches. <br /> Support Facilities and General Mine Plan Compliance: Oil and gas well development have been recently flagged. Two <br /> locations have been staked. Each proposed drill pad have been flagged for 7 potential drill holes.The proposed pad <br /> locations are located in area 21,and area 3. PDC(Oil&Gas company)has not provided CEC with proposed dimensions of <br /> the pads or staked the road corridor location. The flagged hole locations are aligned in a N-S orientation. Actual <br /> dimensions of the proposed pad have not been staked or provided to CEC yet. The access route CEC uses to access Pit A <br /> water well will need to be rerouted based upon final drill pad dimensions and oil and gas access road routes. <br /> CEC continues to dispose of ash in Pit B.. CEC has returned to placement of ash on the lower lift. CEC will continue to <br /> place ash on the lower lift until they reach the northern extent of the B pit. During the inspection an ash truck placed an ash <br /> load and the personnel graded the recent ash piles into the pit. No problems were observed with the pit or the ash disposal <br /> area. <br /> Reclamation Success. <br /> CEC has submitted an application for Phase H Bond Release for reclamation areas 2,5,6, 7,9, 10, 15, 16,23,and 29. <br /> Several of these areas were observed during this inspection. Winter conditions exist with the vegetation dormant and no <br /> immediate concerns with these reclamation areas. <br /> No maintenance problems were noted during this inspection. <br /> pans . of 5 panoc /riatal )/9rionintinitia1cl ihh <br />
