Martin <br />Executive Director <br />Re: Foidel Creek Mine, Permit Number C1982-056, Technical Revision No. 70, Final Decision <br />Dear Mr. Nettleton: <br />The Division issued a proposed decision for Technical Revision No. 70 on February 9, 2010. A public <br />notice of the proposed decision was published in the Steamboat Pilot on February 14, 2010. This public <br />notice initiated a ten-day public comment period that parties having objections or concerns could submit <br />their concerns to the Division regarding this proposed revision. No comments were received by the <br />Division during the public comment period. The public comment period closed at 5:00 pm February 24, <br />2010. Asper rule 2.08.4(6)(b)(iii) the Division's decision is considered final. <br />The revised liability for the Foidel Creek Mine is $8,560,754.04. The Bond currently held by the Division <br />is $8,513,089.00. TCC must submit additional monies to the bond in the amount of $47, 665.04 or <br />greater, prior to implementation of the construction activities associated with TR70.
