Permit Revision No. 10, Expand B-Seam Mine Plan to the North, Third Adequacy Review
Dear Mr. Bear:
The Colorado Division of Minerals and Geology (Division) has finished its adequacy review of Bowie
Resources LLC's (BRL) responses dated December 28, 2006 to the Division's two adequacy letters dated May
18, 2006 and June 6, 2006 for Permit Revision No. 10 (PR-10). The following is the current status of the
issues:

Rule 2.03
The Division has conducted an Applicant Violator System (A VS) computer check of the Bowie No. 2
Mine permit. The recommendation is to "issue". The Division will conduct similar A VS checks at the
time of the Division's proposed decision and at issuance time for PR-10.
No response was required by BRL.
Rule 2.04
2. As indicated in the PR-10 application, BRL intends to install additional groundwater monitoring wells
in Hubbard Creek north of the proposed mine plan area. The Division concurs, because of the northern
extension of mining BRL will need to add additional down gradient groundwater monitoring wells to the
hydrologic monitoring plan. Please provide the Division with the proposed plan for well installation
prior to drilling and constructing the new wells. Also, please update the appropriate permit application
text, including the completion summary table. Groundwater monitoring of each aquifer above, within
and, ifpotentially impacted, below the lowest coal seam to be mined will be required in accordance with
Rule 2.04.7(1).
BRL responded that a revision for new down gradient groundwater monitoring wells will be submitted
soon. However, there is a possibility that the wells won't be needed. BRL is in the process of
attempting to document that the drilling of the wells would be unreasonable when one considers
drilling costs versus benefit.
3. Because future mining will be extending northward past the current upgradient stream monitoring
locations on Hubbard Creek and Terror Creek, please propose new upgradient stream monitoring
locations for these two streams. The new locations should be upgradient ofall proposed mining. For
