P.E. <br />Division Engineer <br />The purpose of this letter is to provide the Division of Reclamation, Mining, & Safety (DRMS) with <br />comment on Bowie Resources, LLC (BRL) responses to DRMS' June 6,'2007 adequacy response for <br />the above referenced mining permit revision. Our comments are limited to those pertaining to the <br />potential impact of mine-induced seismic activity on the safety of Bruce Park Dam and are intended to <br />supplement of our previous letters to you dated June 11, 2003, May 16, 2006, and June 4, 2007. <br />It is our understanding that the Geotechnical Monitoring Plan for the Bruce Park Landslide prepared by <br />Yeh and Associates, Inc. dated March 26, 2008 has been included as Tab 20 in Volume IIIA in order to <br />address development of a threshold monitoring program for the landslide. Our office has reviewed the <br />proposed monitoring program and, has found it acceptable as a means of monitoring the landslide and <br />providing real time data along with a response action plan based on trigger levels and alarms. <br />Implementation of the monitoring program, as submitted, satisfactorily addresses our concerns of <br />providing a threshold monitoring program for the landslide during the proposed mining activity. <br />A concern by our office not addressed in BRL's response to DBMS is providing monitoring of Bruce <br />Park Dam itself during the proposed mining. While our office continues to support previous conclusions <br />that the risk of failure of Bruce Park Dam due to mine-induced seismic loading appears minimal, we still <br />feel that including monitoring of the dam is imperative. As stated in our May 16, 2006 letter, we <br />recommend including periodic measurement of the existing piezometers and movement monuments on <br />the dam crest as a part of the overall geotechnical monitoring plan. <br />Water Division 4 • Montrose <br />P.
