The following summarizes site <br />maintenance and reclamation activities that occurred at the Marr Mine and at the associated <br />Loadout during the year 2009. <br />To recapitulate, active mining and related activity was suspended and final reclamation activities <br />were initiated in early 1993. Final reclamation of most mine disturbance areas was completed <br />during the period from 1993 through 1996. Disturbance areas reclaimed in 1999 - 2000 <br />included the Loadout Area, a portion of the shop/warehouse facilities pad and the former <br />powder magazine area, soil stockpile area and associated road. All areas reclaimed in 1999 <br />except the Loadout, were initially seeded to the annual rye mulch crop followed by the <br />permanent revegetation seeding in 2000. The Loadout was seeded to the permanent <br />revegetation seed mixture in 1999 and re-seeded with the permanent mix again in the fall of <br />2000. A final bond release (SL-4) was approved for the majority of the mine area with final <br />approval effective January 5, 2009. Two small parcels located at the mine were not released <br />because they were not yet eligible for release. The Loadout site was approved for a Phase 2 <br />Partial Release but is not yet eligible for Phase 3 release. Detail of the bond release follows in <br />Item 1 of this report. <br />As part of Kerr's regular site maintenance activities, the surface water control structure at the <br />Loadout was inspected. Any concerns noted by the Division of Reclamation, Mining and Safety <br />(DRMS) in their regular site inspection reports were considered. For certification, the <br />pond/embankment was inspected by a registered P.E., Mr. Brian Len of NWCC, Inc. of <br />Steamboat Springs, Colorado during May, 2009. Based on inspection, the surface water control <br />structure at the Loadout was found to be in good condition.
