February 19, 2010 <br />Precision Excavating, Inc. <br />PO Box 790 <br />Hayden, Co. 81639 <br />Division of Reclamation Mining and Safety <br />Attn: Mr. Peter Hays <br />1313 Sherman St. Room 215 <br />Denver Colorado 80203 <br />0"'Rmelv'eo <br />F <br />of Rgwaalavo <br />a' <br />RE: Technical Revision Request for Camilletti Milner Pit #2 Amendment (M-2001-023) <br />Dear Mr. Hays: <br />Precision Excavating, Inc. as the Operator of the Camilletti Milner Pit #2 (#M-2001-023) requests a <br />technical revision to the permit to revise the Mine Plan Map for the amendment area and to incorporate <br />the Construction Plans for the Bridge and Conveyor over Trout Creek. The Bridge and Conveyor <br />Construction Plans dated December 15, 2009 were sent to you under separate cover. The included Mine <br />Plan Map dated February 19, 2010 will replace the approved Mine Plan Map dated July 21, 2009 on file <br />with the Division. The purpose of this change is to adjust the phasing of the proposed mining blocks as a <br />result of recent discussions with the Army Corps of Engineers relative to the wetlands impacts. <br />The ACOE has decided that they will not issue a 404 permit to provide off-site mitigation of the affected <br />wetlands within the pit boundary. Instead they will allow excavation of the wetland areas under the <br />Tulloch Rule. We have discussed this option with both the ACOE and with Routt County officials. As a <br />result of these discussions, we have requested that Routt County approve a minor amendment to the <br />previously approved Mine Plan Map. Accordingly, we have withdrawn from the ACOE our 404 permit <br />application. This minor amendment to the mine plan has recently been approved by Routt County as <br />evidenced in the attached Special Use Permit Amendment. <br />Even though we have withdrawn our 404 permit application, we still feel it is appropriate to perform the <br />anticipated off-site wetland mitigation and we have made this commitment to Routt County. Therefore, <br />we have entered into an agreement to purchase wetlands at the Finger Rock Preserve wetland bank in the <br />same amount and manner as if the 404 permit had been issued. <br />We have included a check for $216 for the technical revision fee.
