STATE OF COLORADO
DIVISION OF RECLAMATION,,MINING AND SAFETY
Department of Natural Resources '
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832=8106
February 23, 2010 .
Ms Angela Bela.ntoni
Environmental Alternatives
11-07:Mairi Street
Canon City;.CoW212
Re: M-1980-224 Asphalt Paving and Redi Mix, Mackenzie Pit Am # 2 Adequacies.
Dear Ms Belantoni
COLORADO
D I V I S I ON OF
RECLAMATION
MINING
SAFETY
Bill Ritter, Jr.
Governor
James B. Martin
Executive Director
The Division has completed the revised amendment application for the Mackenzie Pit M-1980-224
application `.submitted on January 6, 2010. The total amended permit area is 49.3 acres, of which the
amended revised plan proposes to remove 30.64 acres which are reclaimed as industrial development
from the permit The rest of the mined permit affected area covering 24.78, which added 5.94 acres
under the revised plan, is also zoned commercial industrial as post mining land use.
Exhibit D Mining Plan and Exhibit E - Reclamation plan
As we discussed in the field, since the current approve mining and reclamation plan for the site is not
clear, and,.does not have a detailed mining and reclamation narrative, to avoid future confusions. The
Division requests a new mining and reclamation plan Exhibits D and E, as part of fulfilling the
requirement.
The Division is aware that the post mining land use will only require the operator to reclaim the pit
slopes, and grade the rest of the affected areas to meet the required post mining topography for
Industrial/ commercial. Such areas must be graded to almost flat and the operator will need to
determine the # of acres that will be worked at any given time, if the wish is not to post the entire
warranty for the acres that will be graded but not seeded, this will be the time to determine how many
acres will be graded. Given the small size of the area to be graded flat, the Division recommends the
operator to include all the flat areas that will remain in place in the 24.78 acres .
Exhibit L Reclamation Cost
Once the Division receives the detailed mining and reclamation plan, the warranty will be calculated
accordingly.
All. other exhibits are adequate, it is the understanding of the Division that the operator.has secured all
damage agreements from owners of permanent structures within 200 feet of the proposed affected
area.
Office of Office of
Mined Land Reclamation' Denver Grand Junction Durango Active and Inactive Mines
