Sherman
Executive Director
Ronald W. Cattany
Division Director
Natural Resource Trustee
The Division of Reclamation Mining and Safety (DRMS) has reviewed adequacy responses for the above referenced
112c application. While most issues have been addressed a few need further correction or clarification. Please
address the following:
1) The response to the request for proof of public publication is inadequate. The Division requires a
notarized "affidavit of publication" from the publishing newspaper. Please supply the required affidavit.
2) The revised maps identify four adjacent landowners. Supplied green cards note seven entities that are not
identified on the maps. Please provide a parcel map or a corrected site plan map that clearly shows all
persons or entities owning land within two hundred feet of the permit boundaries.
3) The Mine Plan and Exhibit S note no manmade structures within 200 feet. Please note that on supplied
maps there is a power line within 100 feet of the affected area and it transects the permit area in Phase 1.
Also a power line enters the southwest section of Phase 3 to a structure.
Currently the decision date on the amendment is February 19, 2010 provided all issues have been addressed. Staff
will calculate the reclamation liability estimate in anticipation of meeting that date. If however United Companies
needs additional time to address the noted issues please request an extension of the decision date no later than
noon of the 19th.
If you need additional information please contact me at the Division of Reclamation, Mining and Safety, Grand
Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, or by telephone no. 970.241.1117.
Sincerely,
G.
