E. Based on Division inspections, is all of the rock at the Paonia sewage lagoons really <br />sandstone? If it all is (or at least appears to be) that is fine. If, however, there are other <br />rock types, additional samples and analyses may be warranted. <br />2. Revised permit application page 2.05-39ii in TR-51 states that exporting 3, 000 cubic yards of <br />excess rock from the Hubbard Creek vent shaft pad site would lower the reclamation topography <br />of the site by 1.2 feet. The Division finds this acceptable in achieving approximate original <br />contour. <br />No response was needed. <br />The TR-51 submittal included letters from the USDA-Forest Service and the Town of Paonia in <br />which the two government agencies agree to the permanent storage of the excess rock at the <br />Paonia sewage lagoons. As a requirement for revision approval, please provide a copy of the <br />Free Use permit mentioned in the USDA-Forest Service letter dated December 4, 2007 when it <br />has been issued. <br />The Division has no further concerns. BRL provided a copy of the USDA-Forest Service invoice <br />for the excess rock that had been transported to the Paonia sewage lagoons. <br />4. The USDA-Forest Service letter provided in TR-51 states "If material is removed from the Forest <br />and not sent to the Town, then the USFS must charge Bowie for that disposition. " According to <br />revised page 2.05-39ii of the TR-51 submittal, approximately 1,200 cubic yards of excess rock <br />were transported to the Bowie No. 1 Mine (3, 000 cubic yards minus 1,800 cubic yards). <br />Therefore, please respond to the Forest Service letter and provide documentation to the Division <br />that the issue of the permanent storage of the Hubbard Creek vent shaft pad excess rock at the <br />Bowie No. 1 Mine has been resolved with the Forest Service. <br />The Division has no further concerns.
