MANAGEMENT <br />Abatement step number 3 for the referenced notice of violation required the <br />Operator to transport excess rock from the Paonia sewage lagoons to the Bowie <br />No. 1 Mine or obtain Division approval through a technical revision to keep the <br />excess rock at the lagoons. On behalf of Bowie Resources, LLC, (BRL) <br />enclosed is an application for a technical revision to allow BRL to leave the rock <br />at the lagoons. <br />By letter dated December 4, 2007 to BRL, the USDA-FS agreed to issue the <br />Town of Paonia a "Free-use" permit for the excess materials generated at the <br />shaft site. By letter dated December 4, 2007, the Town of Paonia informed BRL <br />it has agreed to accept the rock. <br />Narrative was added to new page 2.05-39ii which explains the developments <br />surrounding the disposal of the rock at the sewage lagoons.
