III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial coal inspection conducted by Jason Musick of the Colorado Division of
Reclamation, Mining, and Safety (Division) on 10 February 2010. The weather was clear and the
mine site was snow covered during the on-the-ground inspection. Scott Wanstedt of BME
accompanied the inspection and Rob Zubak of DRMS.
The mine is currently operating as permitted. No drilling activities were in progress during the
inspection. Deserado Mine continues to longwall in panel 10.
Signs and Markers
BME has submitted a proposal of BMEs compliance of 4.02 in reference to perimeter area markers
for the Divisions review. The Division is in process of reviewing BMEs proposal at the time of this
inspection.
Roads
The haul road was clear of snow and stable at the time of the inspection. Access roads in and around
the facilities area, conveyor and the refuse disposal area were snow covered and stable. Roadside
ditches were snow covered at the time of the inspection with no problems noted.
Hydrologic Balance
DP-1 pond was snow covered at the time of the inspection. The embankments were stable and snow
covered at the time of the inspection. The principal and emergency spillways were stable and in
compliance at the time of the inspection. No discharge was noted.
PP-1 and PP-2 ponds were iced over and snow-covered at the time of the inspection. Embankments
were snow covered and stable. No problems were noted.
SS-1 and SS-2 ponds were snow covered at the time of the inspection. Embankments were stable
and snow covered and spillways were in compliance with no problems noted.
Ponds RP-2/3, 4, and 5 were snow covered with no ice noted. Embankments were snow covered
and stable with o identifiable compliance issues noted.
