III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial coal inspection conducted by Jason Musick of the Colorado Division of
Reclamation, Mining, and Safety (Division) on 08 February 2010. Rob Zubak of DRMS accompanied
the inspection. The weather was cloudy and snowing during the on-the-ground inspection of the site.
There was a substantial amount of snow cover throughout the mine site and access to the entire mine
site was limited. A portion of the inspection was conducted from County Road 29 to the west of the
mine site.
Signs and Markers
The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the
south, the entrance off of County Road 29 and the North Road entering the mine area from the north.
All mine I.D. signs contained the required information and were in compliance with no problems
noted.
Roads
The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond
Road, and West Ridge Road were covered with a substantial amount of snow and access was either
limited or inaccessible. Portions of the North Road the Old Tipple Road, Lower Moffat Road, Center
Ridge Pond Road, West Ridge Pond Road, and West Ridge Road were inspected from County Road
29 and no problems were noted.
Hydrologic Balance
All sediment ponds identified contained frozen water with substantial ice and snow cover evident. All
embankments were stable with no visible signs of erosion or damage. The four Moffat down drains
were covered in snow but appeared stable with no evident signs of damage.
The "string-of-pearls" permanent drainage channel was completely covered with snow. The area
appeared to be stable with no signs of damage.
Support Facilities
Due to the substantial amount of snow cover, the permanent buildings at the mine site were
inaccessible. These buildings were observed from County Road 29 and no problems were noted.
The permanent office located on Old Tipple Road was observed off of state highway 131 and
appeared stable with no problems noted. All three permanent sediment ponds and the check dams
appeared to be in compliance.
Reclamation Success
Although snow cover made visibility of reclamation success difficult, there did not appear to be any
problems with reclamation at the mine site during this inspection.
