Letter to Ryan J. McHale 8 February 16, 2010 <br />Permit Application Adequacy Review File No M-2009-076 <br />and the maps show that leaks in the lines would be outside containment by the tailing impoundment. The <br />DRMS will require the installation of facilities to contain potential leaks from these pipelines, such as double <br />walled lines. Provide a leak containment plan. DRMS will further require that the pipelines be drained at all <br />times when the site is unmanned; provide a commitment to-do so. <br />26. The Office of the State Engineer provided comments on the permit application in a memo dated December <br />8, 2009. Venture Resources was previously provided a copy. The memo states that storm water captured out <br />of priority must be released or infiltrate within seventy two hours. Describe how Venture Resources will <br />comply with this requirement for each proposed facility that may capture storm water recognizing that storm <br />water comingled with crusher feed pad water, tailing impoundment water, and holding pond water may not be <br />released to the environment. <br />27. Clear Creek County provided comments on the permit application in a letter dated December 16, 2009. <br />Venture Resources was previously provided a copy. The following issues raised by the County must be <br />addressed. <br />a. The maps provided with the permit application illustrate a number of roads within the area of affected land. <br />These are identified in the application as public roads. The County comment letter states that public roads <br />may not be used for storage or parking of equipment. Provide a commitment that the roads will not be used <br />for storage or parking. <br />b. The maps provided with that permit application appear to illustrate a road segment that will be buried by <br />impoundment of mill tailing. If this is the case, provide a description of the legal right to eliminate the road <br />segment. <br />c. The permit application states that a portable toilet will be located on the site. The County comment letter <br />states that the Clear Creek County Environmental Health Department should be consulted on sanitary <br />facility requirements for the proposed operation. If facilities other than the portable toilet described in the <br />application are required by the County, then the permit application must be modified accordingly. <br />d. The County comment letter states that road maintenance permits from the Clear Creek County Road and <br />Bridge Department may be required; if so, these permits must be listed in a modified Exhibit F. <br />The date for consideration for the permit application is March 11, 2010. Please respond to the issues listed in <br />this letter by that date or the application may be denied. An extension will be granted upon written request. <br />Responses and a copy of this letter must be placed for public view with the Clear Creek County clerk and <br />recorder in accordance with Rule 1.8.1.
