This office has <br />reviewed the sequence of activities and the proposed construction of the cofferdam detailed in a letter <br />dated February 1, 2010 and we have no comments the proposed design of the cofferdam. <br />The owner is liable for the safety of the cofferdam and for any loss of life and/or damages caused <br />by a failure of the cofferdam in accordance with State Statutes. This letter does not relieve the owner <br />from this liability or from any other statutory obligation. Therefore, it is in the owner's best interest to <br />assure that the cofferdam is designed, operated and maintained in a manner such that the safety of <br />the cofferdam, downstream work, and the general public are not jeopardized. Also, permits from <br />other local and federal agencies may be required prior to the start of construction of this project.
