In accordance with procedures outlined in 30 CFR
906.30, Appendix B, the Forest Service reviewed the Technical Revision for post-mining
land use consistency with land use plan (GMUG Forest Plan), and the adequacy of
measures to protect non-mineral surface resources, as proposed by Bowie in their
application.
According to Bowie's Mine Permit and associated Map 13, the post-mining land use is
"Rangeland & Wildlife Habitat". This is consistent with the Forest Plan; however the Plan
specifically prescribes managing this area for wildlife habitat with an emphasis on Forest
Service Management Indicator Species (MIS). As such, there are specific requirements for
human activities in these areas, which are brought forward in Attachment A discussed
below.
Regarding the adequacy of measures to protect Federal resources not covered by the coal
lease, by evaluating current Forest Service direction and various resource specialist input,
the activities proposed in TR-53 must be conducted consistent with measures listed in
Attachment A in order to adequately protect surface resources on NFS lands.
In addition, provided that the application is not further modified, and the conditions of
Attachment A are carried forward in the DRMS' decision, this letter constitutes USFS
consent/concurrence to the decision.
Also, the FS requests that the future project related documents (e.g. decision and public
notices) DRMS acknowledge that protections for non-mineral resources brought forward by
the GMUG as the land management agency are included in the DRMS decision /
documentation.
Sincerely,
LEVI K.
