The Division has no further concerns. As stated in the October 5, 2007 submittal, BRL accepts the <br />Division's reclamation cost estimate. <br />20. In order for BRL to receive the credit mentioned in item number 14 above, please revise the text in <br />the permit application to eliminate references to the refuse bin and conveyor, eliminating the <br />possibility that they can build it in the future. Additionally, the minimal 0.1 acre disturbance will <br />require no backfilling and grading that has not already been estimated and bonded for. The <br />additional road spur is in a level area and no real earthwork is necessary. There is, however, a <br />cost to remove the culverts, which is included in the demolition task sheet. <br />The Division has no further concerns. BRL had already eliminated the references on pages 3 and 8 <br />of Volume XI in the original submittal. <br />Rule 2.05.6, Mitigation of the Impacts of Mining Operations <br />21. Please explain how BRL will prevent coal waste from going into the Fire Mountain Canal from <br />the haul trucks crossing the bridge that goes over the canal. <br />In the October 5, 2007 submittal, revised page 2.05-24i was provided that described the bridge as <br />having steel plates on the running surface and sides that will prevent coal waste from spilling into <br />the Fire Mountain Canal. However, as mentioned in item number 3 above, the Bureau of <br />Reclamation still has to issue its permit. The Division has no concerns with the bridge as long as <br />the Bureau of Reclamation has no concerns with the bridge. <br />22. Please include in the application a requirement for, and procedures for, clean-up of coal <br />processing waste spills on Highway 133, the segment of new haul road, and the bridge across the <br />Fire Mountain Canal (pollution control of air and water). <br />The Division has no further concerns. Revised permit application page 2.05-24i from the October <br />5, 2007 submittal describes the clean-up procedures for any spills on old Highway 133 and the <br />haul road. <br />Section 2. 10, Maps and Plans <br />23. The material storage area delineations were removed from revised Map 15-1 and revised Figure <br />1. Please revise Map 15-1 and Figure 1 to restore the material storage area delineations on the <br />maps and in the legends. <br />The Division has no further concerns. Map 15-1 and Figure 1 were revised in the October 5, 2007 <br />submittal. <br />24. Please explain why the SAE 9 delineation was removed from revised Map 20. Even though <br />designs were approved that show that silt fence is no longer needed at the site, it is still a small <br />area exemption. <br />The Division has no further concerns. Map 20 was revised in the October 5, 2007 submittal. <br />5
