Box 165 <br />La Junta, Colorado 81050 Canon City, Colorado 81215 <br />719-383-2600 719-275-1280 <br />February 9, 2010 RECEMED <br />Jared Ebert r/FEg 10 2010 <br />Division of Reclamation, Mining & Safety <br />1313 Sherman St., Room 215 Division oi mawametwn, <br />Q Mkft%and Safety, <br />Denver, CO 80203 <br />RE: Technical Revision for Permit M-1997-071 Caldwell Nesselhuf Pit <br />Dear Mr. Ebert, <br />As per your inspection dated October 19, 2009, you are requiring the site to be changed to a <br />Intermittent Site. <br />The land owners, William and Beverly Caldwell and Albert and Lola Nesselhuf would like to <br />request that the site be changed to an intermittent site in accordance with rule 1.13.7, which is <br />a Substitute Notice for of Temporary Cessation and rule 1. 13.5 Notice by Operator. <br />Due to the economic times the mining operations have been very slow. The site was last mined <br />in approximately 2003. The Operator continues to remove the processed material from the site <br />as needed, but at this time it is unknown when mining will occur again. The Operator does plan <br />to start reclamation at the site, as soon as weather will be permitting. The mining will resume <br />as our economic needs increase. <br />As stated in the last inspection the financial warranty is adequate to reclaim the disturbed area <br />to date.
