The Applicant has selected a post-mining land use of general agriculture. However, the <br />Reclamation Plan indicates the site will contain two lined reservoirs upon completion of <br />reclamation. The Division feels that a more appropriate post-mining land use would be <br />developed water resources. Please change the post-mining land use to developed water <br />resources or provide a justification for a post-mining land use of general agriculture. <br />6.4.1 Exhibit A - Legal Description <br />No comment. <br />6.4.2 Exhibit B - Index Map <br />No comment. <br />6.4.3 Exhibit C - Pre-mining and Mining Plan Map(s) of Affected Lands <br />5. The Division requests the Applicant illustrate the FEMA designated flood plain on Exhibit <br />C-2 Mine Plan Map. <br />6.4.4 Exhibit D - Mining Plan <br />6. Please indicate the maximum depth of the excavation and the angle at which pit walls will be <br />mined. <br />7. The Applicant has stated topsoil will be salvaged and placed into stockpiles. Please describe <br />how topsoil stockpiles will be protected from erosion. Indicate if topsoil stockpiles will be in <br />place longer than one growing season, and if so, specify the type and quantity (PLS/acre) of <br />seed mix that will be used to vegetate the stockpiles. <br />8. Please specify if fuel will be stored on site. If so, the operator must indicate that there is a <br />Spill Prevention Control and Countermeasure (SPCC) plan in place and that the SPCC plan <br />will be implemented prior to storage of fuel or oil products. This can be done by submitting a <br />letter to the Division, on company letterhead, affirmatively stating that the plan has been <br />implemented. The operator does not need to submit a SPCC plan to the Division; however it <br />must be available for review at the facility or the nearest field office during an inspection <br />conducted during normal business hours. <br />9. Under the current permit, the Applicant stated stockpiles would surround the entire permit <br />boundary to facilitate backfilling and mitigate flooding of the pit. Please clarify if stockpiles <br />will be placed around the entire permit boundary or only in the designated stockpile locations <br />as depicted on the Mine Plan Map.
