Catiany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, <br />Section 118, Paragraph 3, of the Colorado Revised Statutes, that on February 8, 2010, an application to renew an <br />existing permit to conduct coal mining operations at the Yoast Mine was considered complete for the purposes of <br />filing. Seneca Coal Company has submitted an application for successive renewal (RN-3) for the mining and <br />Reclamation permit for the Yoast Mine (Permit # C-1994-082). All review and comment periods as provided in <br />the Colorado Surface Mining Reclamation Act and the Rules initiate from this date of filing. <br />Seneca Coal Company, LLC proposes to continue Surface coal mining and/or reclamation operations on land <br />located approximately 7 miles Southwest of Hayden, Colorado. The permit area is further described as follows: <br />T6N, R87W, Portions of Sections 28, 29 and 32 <br />T5N, R87W, All of Section 17; Portions of Sections 5, 8, 16,18, 19, 20, 29, 30 <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Dunckiey and Mount <br />Harris. <br />The above-referenced permit renewal application would not incorporate additional lands into the permit area or <br />otherwise alter previously approved permit conditions or mitigation measures pertaining to cultural and historic <br />resources. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have <br />your concurrence in order to approve this proposal. We are required to make a finding that "the proposed <br />operations will not adversely affect any publicly owned park or place listed on or those places eligible for listing, <br />as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and <br />the Federal, State, or local agency with jurisdiction over the park or place." Therefore, we request that you submit <br />comments regarding your concurrence with, concerns with, or objections to this proposal.
