III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />stockpile was clear of snow and appeared to be stable. The upland diversion ditch was covered in snow. The <br />coal waste pile had positive drainage. There was a little ice covered water in pond F. The coverfill pile was <br />stable. <br />There was no activity at coal waste pile no. 3. The area was partially covered in snow. The topsoil sign was up <br />on the topsoil stockpile. The collection ditch leading to pond J was snow covered, as was the down gradient <br />berm. <br />Unit Train Loadout <br />The coal overhead conveyor corridor that leads to the unit train loadout was partially covered in snow but no <br />problems were observed. Material storage areas along the corridor were well organized. <br />A loaded unit train was on site. There was no evidence of any fugitive dust at the loadout. The loadout bench <br />was partially covered in snow but appeared to be stable. The bench outslope had a good vegetative cover. Some <br />of the sediment control ditches and culvert inlets and outlets were covered in snow. Pond J and pond K were <br />covered in snow. There did not appear to be any standing water in the ponds, however. The mine id sign was up <br />at the entrance and surface disturbance markers were up. <br />Hubbard Creek Fan Site <br />The road up the Hubbard Creek drainage had been plowed and was in good condition. Mine id signs were up <br />where the permit boundary crossed the public road. The fan site was covered in about 2 feet of snow. A path <br />from the road to the fan had been plowed. The mine id sign was up and surface disturbance markers were in <br />place. The upland diversion ditch was snow covered. The noise from the fan was not loud. <br />Records <br />The records were located at the mine office and were in compliance.
