III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the Bear <br /> Coal Company during the field inspection. Snow covered the entire mine site but the snow was only 6 inches <br /> deep at most. There was no activity on site. <br /> Signs and Markers <br /> The mine identification sign was up at the top of the hill. The required information was on the sign.Also in this <br /> location was the"records location"sign.The perimeter of the surface disturbance was marked except on the <br /> steep hillside and above the cliff,due to safety concerns. <br /> Roads <br /> The paved haul road and the bridge across the North Fork of the Gunnison River were snow covered.The guard <br /> rail on the outside edge of the road was in place. The"no trespassing"sign was on the entrance gate,which was <br /> open. <br /> Hydroloey <br /> The sediment pond was completely covered in snow.There was no pool of water in the pond and the primary <br /> discharge valve was closed. <br /> The hillside spring water treatment pond had ice and snow covered water in it.The pond was discharging at <br /> about 10 gpm. The pond discharge had the usual orange color,which has been shown to be in compliance with <br /> water quality standards. The hillside spring was flowing into its collection ditch and culvert that leads into this <br /> treatment pond. <br /> The berm along the river was snow covered but appeared to be functional. The collection ditch that leads to the <br /> sediment pond had enough capacity.The caps were on the two alluvial wells. <br /> Reclamation <br /> The flat facilities area and the reclaimed hillside were covered in snow.However,it appeared that the reclaimed <br /> road leading to the reclaimed fan site area was stable.The reclaimed fan site area also appeared to be stable. <br /> c:/word2007/bear3/insp0210 <br />
