III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 28 Jan 10 � <br /> Pg 1/3 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDRMS. <br /> The inspection was conducted on 28 January 2010. Ryan Pawlowski of CCC <br /> accompanied me on the inspection. The weather was cold and snowing and there <br /> was approximately 3-6 inches of snow on the ground at the time of the inspection <br /> (from the current snow as well as from previous snow storms). The mine was not <br /> operating at the time of the inspection as all equipment was down for routine <br /> maintenance (including coal haulage to the loadout). <br /> Roads: - The main haul road/access road was covered with snow at the time of the <br /> inspection. The road is a paved road and was in good condition. <br /> - Colowyo has almost completed the new South Taylor haul road (approved through <br /> Technical Revision 76). The remaining work includes establishing a crown on the <br /> road, ensuring that the road is the proper grade and width for its entire length and <br /> surfacing the road. Colowyo is currently using the South Taylor Haul Road and the <br /> remaining items must be completed and the road certified by a registered, <br /> professional engineer. The haul road is partially an in-pit road (the portion that is <br /> within the limits of the West Pit) and partially a haul road that must be designed and <br /> certified pursuant to Rule 4.03.1 . Upon completion of the haul road Colowyo must <br /> certify the road pursuant to Rule 4.03.1(1)(d)(1) and provide the Division with a <br /> construction report and an as-built map of the road. <br /> - With the construction of the South Taylor Haul Road the majority of Haul Road A and <br /> all of Haul Road B have been removed from use for the mining operations. Portions <br /> of these roads remain open for access to the north side of the final cut of the Section <br /> 16 Pit and the East Pit. These portions of the road were covered with snow but <br /> remained stable and in good condition. <br /> - The in-pit road to the overburden dumps in the Taylor Fills and the Section 16 Pit <br /> area were covered with snow but remain stable and well maintained. <br /> - The roads in the Gossard loadout were all well maintained and stable at the time of <br /> the inspection. <br /> Hydrologic Balance: - The Gossard Pond (NPDES 003A) contained water <br /> approximately two feet below the discharge pipe and was not discharging. The <br /> pond embankment was covered with a small amount of snow but remains well <br /> vegetated and stable. The concrete sump at the inlet of the pond has done a good <br /> job in keeping sediment out of the pond. <br />
