Cattany <br />Centennial, CO 80112 Division Director <br />Natural Resource Trustee <br />RE: Response to Correspondence Dated January 26, 2010, May Day Mine, Permit No. M-1981-185. <br />Dear Mr. Robinson: <br />On February 2, 2010, the Division received your correspondence, dated January 26, 2010, addressing the <br />Division's latest reclamation cost estimation totaling $148,329. In that correspondence, you request that <br />the Division incorporate the plans proposed in the new 110(2) application for the Mayday Mine and Mill, <br />File No. M-2010-005, and apply those plans to the current reclamation cost estimation at the May Day <br />Mine, Permit No. M-1981-185. <br />The Division cannot implement the plans proposed in the new application until that application is fully <br />approved. Until that time, the Division must proceed in accordance with the approved reclamation plan <br />for M-1981-185, which does not authorize on-site disposal of mining related equipment and/or <br />structures. The issue of whether the site is appropriate for on-site disposal will be resolved during the <br />adequacy review process for the new application. <br />Pursuant to Rule 1.4.1(8), the Division is reviewing the application for the Mayday Mine and Mill, File No. <br />M-2010-005, and will inform Wildcat Mining Corporation whether the application is complete for the <br />purposes of filing. As stated in previous communications, the application for the Mayday Mine and Mill <br />identifies Wildcat Mining Corporation as the permitting contact and not R2 Incorporated. Therefore, the <br />Division will not be communicating directly with R2 regarding the permit application. As previously <br />requested, if Wildcat desires R2 to act on its behalf as permitting agent for the new application, please <br />have Wildcat submit a letter of authorization on Wildcat letterhead and signed by James M. Clements, <br />President of Wildcat Mining Corporation.
