("Wildcat Mining") pursuant <br />to Colorado Mined Land Reclamation Board ("MLRB") Rule 4.2.1(2) to provide a <br />formal Notice of Disagreement with the Colorado Division of Reclamation, Mining and <br />Safety's ("DBMS") December 17, 2009 Notice to Increase the Financial Warranty for <br />the May Day Mine located in LaPlata County (M-1981-185) (the "Notice"). <br />Specifically, in its Inspection Report for the May Day Mine dated December 17, 2009, <br />DRMS Staff prepared bonding calculations and recommended increasing the bond for <br />the May Day Mine to $148,329.00. DRMS requests in the Notice that Wildcat Mining <br />post an increased bond in the amount recommended by DRMS on or before February 15, <br />2010. <br />Wildcat respectfully requests that the DRMS place this matter on the agenda for <br />the April 2010 hearing before the MLRB. I understand that because Wildcat Mining has <br />filed a written objection, the DBMS will not take enforcement until this matter is heard <br />by the MLRB pursuant to Rule 4.2.1(2).
