Mining of this site <br />was completed in 2003, and the aggregate processing plant and asphalt plant were removed. Material <br />stockpiles were depleted in 2007. All reclamation earthwork has been completed and dewatering of the <br />site ceased in 2008. Seeding/re-seeding of all upland and wetland areas above expected pond water <br />levels, except approximately 7.5 acres of previously established vegetation, was completed in February, <br />2009. The enclosed map (Exhibit A: Areas for Reclamation, dated September 23, 2008) depicts the <br />upland and wetland areas and expected pond water surface. <br />With all earthwork and seeding at the site completed, the only remaining reclamation activity at this site is <br />maintenance for weed control and establishment of vegetation. Aggregate Industries' cost for the seeding <br />that was done in February, 2009, was $58,024. Using a failure rate of thirty percent (30%) of that <br />amount, which is what the Division proposed in another recent bond calculation, we would estimate <br />potential remaining reclamation costs for this site to be $17,407. We are therefore requesting a reduction <br />of the current financial warranty of $249,008 to the $17,407 estimate. <br />This site is currently owned by 83rd Joint Venture.
