Therefore, the requirements of this rule are not applicable to the permit <br />revision application. <br />Rule 2.06.12 -Surface Coal Mining and Reclamation Operation Requirements Involving [he Removal of <br />Coal from Coal Retuse Piles <br />(1) Scope. The provisions of 2.06.12 shall apply to anv person engaged in surface coal mining and <br />reclamation operations who removes or intends to remove more than 2S0 tons of coal from coal refuse piles within <br />12 consecutive calendar months in anv one location. No person shall engage in operations subiect to 2.06.12 except <br />under a permit or approval of a revision to an existing permit issued by the Division in accordance with [he <br />requirements of 2.06.12. <br />2) Application contents. Bach application for a petmit or approval of a revision to an existing <br />permit subiect to the requirements of 2.06.(2 shall contain that information required by 2.03, 2.04, 2.05, and 2.06 <br />which is necessary for the Division to make a written detemtination of compliance with all requirements of the Act <br />and these Rules in accordance with 2.07.6. The information necessary to satisfy this requirement shall be <br />determined in consultation with the Division and consideration shall be given [o the specific conditions of the site <br />and scope of the proposed operation <br />RESPONSE <br />The mining proposed within this permit area is underground mining.
