EXHIBIT I 1 of 4

REPLY TO
ATTENTION OF
November 5, 2009
Regulatory Division (SPK-2009-01514)
Mr. Ted Pratt
Flintstone Gravel and Trucking Inc.
P.O. Box 950
Granby, Colorado 80446
Dear Mr. Pratt:
We are responding to your request for a Department of the Army permit for the Flintstone
Gravel Pit Access Road project. This project involves discharges of dredged or fill material into
waters of the United States. The project is located in Section 32, Township 2 N, Range 76 W,
Latitude 40.098°, Longitude -105.9366°, Grand County, Colorado.
The project under this permit, as described in the permit application dated October 22, 2009,
consists of widening an existing road across an unnamed tributary to Smith Creek. The existing
road was constructed with a stock pond in 2001. The roadway will be widened at both sides
along the path to the proposed gravel pit and about 0.07 acre of wetlands will be filled as a result.
This wetland fill came about after efforts were made to minimize or avoid wetland impacts. The
impacted wetlands are PEM sedges with limited habitat value near an airport runway. It is noted
that there will not be any adverse effects to endangered species, nor to any cultural or historic
resources as stated in the permit application. It is further noted that the proposed stormwater
collection area will be located uphill of any waters of the U.S.
Based on the information you provided, the proposed activity in approximately 0.07 acres of
waters of the U.S. is authorized by Nationwide Permit Number 14. A signed copy of the
Preliminary Jurisdictional Determination is enclosed. Your work must comply with the general
terms and conditions listed on the enclosed Nationwide Permit information sheets and the following
special conditions:
Special Conditions:
1. You shall provide a visual barrier between wetlands that are allowed to be filled under this
permit and wetland areas immediately next to it to avoid inadvertent disturbance of areas not
covered by this permit. Such visual barrier should include properly erected and maintained
silt fencing and/or highly visible construction fencing. There must not be any disturbance to
adjacent wetlands either via parking, or stockpiling materials.
DEPARTMENT OF THE ARMY
U.S. ARRAY ENGINEER DISTRICT, SACRAMENTO
CORPS OF ENGINEERS
1325 J STREET
SACRAMENTO CA 958142922
