(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1998-inl <br />INSPECTION DATE: U9Ri1n INSPECTORS INITIALS: RKK_ <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site to verify the affected <br />acreage. The site is a 160 acres Phased 112 sand and gravel operation located <br />approximately 5 miles south east of Pueblo Colorado. Site was active at the time of the <br />inspection. <br />Present during the inspection were Messer Joe Gagliano the operator's consultant and Mr. <br />Nick Colarelli of Tony Beltramo & Sons. The site, as stated above is a Phased 112 <br />operation with a maximum affected area at any given time not to exceed 30 acres at any <br />given time. The current warranty for the 30 acres is $97,714.00. <br />The entire site was driven and inspected Most of the activity at the time of the <br />inspection was along the North end of the permit area. Overburden/top soil was stockpiled <br />along the west side of the active mining area. Even without taking an actual survey of <br />the area, it appears the operator had exceeded the 30 acres maximum affected area at any <br />given time. <br />In addition operator was notified to reconstruct the fence and permit boundary marker <br />posts, which were in place at the time of the inspection. <br />In order to avoid future confusions, both the operator and Division agreed to have the <br />operator submit a technical revision to remove the phased bonding and just double up on <br />the maximum affected area from 30 acres at a time to 60 acres. This will allow the <br />operator to move from area to area without being restricted with the Phased plan. <br />Operator also agreed to provide a survey of the permit and affected areas to verify the <br />accuracy and submit the findings with the technical revision.
