Jim Stover
February 5, 2010
Page 3
and should be incorporated into the TR. The Division will field verify the information contained in the
ERO report and all other documentation upon submittal of the TR.
• Determine what overall impact the proposed new pile would have on East Salt Creek and update
the pertinent sections of the PAP accordingly.
• Update the material damage discussion in the PAP and PHC discussions relative to AVFs, if
appropriate.
• Describe the reach of East Salt Creek that was included in the Regional Practices evaluation (e.g.
down to the Highline Canal). Include mapping of irrigated parcel acreages all the way down to
the Highline Canal.
• Provide an assessment of irrigation ditches. The 11.6 acre and 9.1 acre irrigated fields
downstream in Section 29 appear to lie along the east side of East Salt Creek. Identify the point of
diversion for these fields.
• Provide further elaboration to support the statement under the "Groundwater" discussion that
"there is no indication that any of the investigation area is subject to sub irrigation". Substantiate
the basis for this statement (i.e. vegetation communities and species, soil characteristics, soil
mapping, depth of channel incision, alluvial water level data, etc.).
• Provide detailed information regarding access roads, support facilities etc. that will be needed for
the new waste pile and that may also potentially impact designated AVF areas.
• Provide for an incidental permit boundary revision.
• Update all appropriate permit text and maps that would change as a result of the re-designated
AVF area associated with the new coal mine waste pile.
I hope that our staff review and preliminary opinion are helpful. Please let me know if you any questions,
or further requests.
Sincerely,
M !(A1 t" P, ?i
Michael P. Boulay
Environmental Protection Specialist
C: Denver File
