Merrill Drive Natural Resource Trustee <br />Pueblo West, Colorado 81007 / <br />Re: Leone Huerfano Gravel Pit, File No. M-2010-004, Receipt of 112 Construction Materials Reclamation <br />Permit Application Package <br />Dear Mr. Gagliano: <br />On January 22, 2010, the Division of Reclamation, Mining and Safety (Division) received the 112 Construction <br />Materials Reclamation Permit Application package for the Leone Huerfano Gravel Pit, File No. M-2010-004. <br />Preliminary review of the information received determined that the following items must be received before <br />the Division can consider your application as being submitted and technical review can begin: <br />Application Form: <br />1. Please provide an applicant/operator or company name (name to be used on permit) for Item 1, Page 1 of <br />the Construction Materials Regular (112) Operation Reclamation Permit Application Form. <br />r <br />2. The Division requires the applicant to provide documentation giving the signer, Frank Leone Jr., the <br />authority to sign on behalf of the company. The registered agent for Leone Sand & Gravel LLC listed with <br />the Colorado Secretary of State is Hope Brunelli. The authorization document may be in the form of by- <br />laws, resolution, affidavit signed by corporate secretary, certified secretary statement or a notarized <br />statement on company letterhead signed by Hope Brunelli. <br />3. The Division requires the Operator name remain consistent and matches the exact name registered with <br />the Secretary of State's office (Leone Sand & Gravel LLC) throughout the application. Please include the <br />applicant/operator name on Page 1, Item 1 and revise the notary section on Page 8. Please provide the <br />Division with revised copies of Page 1 and an original (signatures in blue ink) copy of Page 8 of the <br />application form. A copy of the summary page from the Colorado Secretary of State for Leone Sand & <br />Gravel LLC and an edited copy of Page 8 of the application are attached for reference. <br />Your application will not be considered submitted until the information listed above is received and found <br />sufficient to begin our review. A decision date will be established 90 days from the date of receipt of all of <br />the requested information. Additionally, if you have already published notice you will need to republish <br />notice, after the Division considers the application submitted. This notice must be published once a week for <br />four (4) consecutive weeks, starting within ten (10) days of the date your application is considered submitted. <br />We will notify you when you should initiate republication of your notice.
