engineering inspection report and determination of methods that are to be implemented. If stability is not attained by
following the plan, a revision may be required.
Anchoring loose materials to native rock may be adequate to stabilize backfilled materials for the short term. But
stabilizing those slopes and reducing erosion and sedimentation to acceptable levels also requires establishing adequate
vegetation, and the Division believes that it is not feasible to revegetate a slope much steeper than 2H: 1V. Please
provide supporting information, or revise the final maximum slope gradient and means of stabilizing it.
It is presumed with fair certainty that the new access road and frontage road, both being permanent features that
require either county- or CDOT-approved designs, will be constructed per those agencies' specifications. This office
has no issues with those roads, but the operator should clarify to this office whether the road construction specs include
grading or drainage on the areas adjacent to the permanent roads.
The stormwater runoff must be adequately controlled per CDPHE-WQCD stormwater management plans.
Descriptions of the siltation basins are adequate. The locations shown for sediment basins and silt fences appear
appropriate, though future runoff and drainage patterns will dictate exact placement. These features will require
maintenance, whether they are temporary or permanent. Please note that the numerous temporary structures included
in this exhibit will require monitoring and maintenance during the life of this permit, but will eventually require
removal since they are not considered permanent features. These items will be carefully inspected by the Division.
Decision Date
The decision date is currently set for January 31, 2010. If additional time is needed for preparing and submitting your
responses, you may submit a written request for extension, specifying a length of time or date.
After all items are found adequate, the amended bond amount may be calculated. Please be as thorough as possible to
ensure that the bond amount can be closely estimated by this office.
All materials should be submitted as hard copies (not electronic) and in duplicate (one original and one set of copies),
and may be sent directly to the undersigned at the Division's Durango field office: 691 CR 233, Room A-2, Durango,
CO 81301; telephone 970-247-5193 and FAX 970-247-5104.
Sincerely,
Dd 4 a"C,
Bob Oswald
Environmental Protection Specialist
Cc: Helen Mary Johnson, BLM Durango
Ec: Steve Shuey, DRMS Grand Junction
(c:\09-11 docs\montoya am-4 adeq ltr3hco)
