Barton and Gilleland, <br />This office has reviewed the materials that were submitted toward Amendment AM-4 of the above-named permit, and <br />in response to the Division's November 11, 2009 adequacy review letter. At this time we have the following <br />comments and questions, which should be addressed before the decision date. Items listed below as being adequate, or <br />not appearing on the list, do not need to be addressed further. <br />Exhibit C - Mining Maps (Rule 6.4.3) <br />These are adequate at this time. In the future, should there be a need to revise the sequence or boundaries of the <br />phases, this may be accomplished via a technical revision. (Please note: The foregoing comment concerning map <br />adequacy is based on the demonstration of right-of-entry onto BLM-managed land in Sections 4 and 9 that are <br />proposed to be added to the permit under this amendment. If such right-of-entry cannot be acquired at this time, the <br />maps will have to be revised for this amendment.) <br />Exhibit E - Reclamation Plan (Rule 6.4.5) <br />This exhibit is not adequate in several areas. Please address the following: <br />The amendment application does not appear to include reference to the seed mix(es) that will be used on private or <br />BLM-managed land. It is not clear if it will be the same seed mix that is presently approved or if it is to be revised. <br />Please clarify these issues as well delineate the areas on the Reclamation Map that will receive different seed mixes if <br />more than one seed mix will be employed, or if they will not be seeded. <br />The final slope gradients described in the reclamation plan, specifically in the eastern area that is presently part of <br />Permit M-2008-048, that are to be created during reclamation and permanent road construction are mainly significantly <br />steeper than 2H:1 V. Some of those final slopes in that specific portion of the pit will be composed of benched native <br />rock and emplaced backfill materials that are layered, compacted and anchored to geotextile materials.
