III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety(Division) on 21 January 2010. The weather was cloudy and the <br /> mine site was wet and snow covered during the on-the-ground inspection. Scott Wanstedt of BME <br /> accompanied the inspection. <br /> The mine is currently operating as permitted. No drilling activities were in progress during the <br /> inspection. Deserado Mine continues to longwall in panel 10. <br /> Sinns and Markers <br /> Mine perimeter markers were identified in areas along the haul road and south of the facilities area in <br /> the area around the DP-1 pond and the PP-1 pond. The markers were identified as metal t-posts with <br /> the top painted white and red. The disturbed areas noted without appropriate perimeter markers were <br /> identified as the refuse disposal areas 2/3/4 and 5. <br /> It is noted that BME will submit a proposal of BMEs compliance of 4.02 in reference to perimeter area <br /> markers for the Divisions review. <br /> Alba— <br /> Perimeter marker at facilities area Perimeter marker along haul road <br /> Roads <br /> The haul road was clear of snow and stable at the time of the inspection. Access roads in and around <br /> the facilities area and the refuse disposal area were snow covered and stable. Roadside ditches <br /> were snow covered at the time of the inspection with no problems noted. <br /> Processing <br /> Refuse piles 2/3/4 and 5 were snow covered at the time of the inspection. Coal processing waste <br /> was being stockpiled on RP-5 at the time of the inspection. The refuse piles were stable and <br /> compacted at the time of the inspection with no problems noted. <br />
