Cattany <br />Division Director <br />Natural Resource Trustee <br />On January 29, 2010, the Division received Kerr Coal Company's (KCC) letter, via fax, requesting the <br />application for technical revision No. 24 be withdrawn. Kerr Coal Company has been unable to procure <br />water rights to allow the operator to permit the Marr Load out pond to remain as a permanent structure. <br />KCC intends to backfill and reclaim the Marr Load out pond in accordance with the approved reclamation <br />plan.
