This <br />NOV was issued for failure to comply with the approved mine plan. The operator updated the <br />mine plan and paid a civil penalty, resulting in the NOV being terminated. <br />Permit Stipulations <br />Permit C-81-035 has one active permit stipulation as shown below. <br />STIPULATION 17 <br />AS REQUIRED BY RULE 2.03.10, THE OPERATOR SHALL ADD TO THE LIST OF OTHER LICENSES <br />AND PERMITS IN THE PERMIT APPLICATION THE APPROVED WATER AUGMENTATION PLAN AND <br />TRANSFER OF WATER WELL RIGHTS THAT ARE IN PREPARATION IN RESPONSE TO THE <br />MEMORANDUM THAT THE DIVISION RECEIVED DURING THE REVIEW OF PERMIT RENEWAL 5 <br />FROM THE OFFICE OF THE STATE ENGINEER, DATED MARCH 12, 2007. <br />King I and II Mines Page 4 January 29, 2010 <br />Midterm Review
