fli!1 Page 5 of 11 <br />Mr. Jared Ebert <br />January 20, 2010 <br />6.4.6 EXHIBIT F - Reclamation Plan Map <br />16. On the Reclamation Plan Maps, there are several berms left in place. One is adjacent <br />to the Phase 2 open water pond, and another is located north of the Phase 2 pond <br />adjacent to the location of Overburden Stockpile A as depicted on the mining plan <br />map. It appears these stockpiles will be constructed with topsoil. According to the <br />Mining Plan (Page D3), no permanent stockpiles will be located at the site. Also, all <br />the topsoil salvaged during the mining process must be re-spread over designated <br />disturbed areas for reclamation. These "berms" should not exist at the end of <br />reclamation, please remove them from the reclamation plan map. <br />These berms are being provided as shown at the request of Mr. Livingston, the <br />landowner. To be consistent with DRMS requirements, we have noted on Exhibit F <br />that the berms will be constructed of overburden and then topped with 10 "-12 " of <br />topsoil. We have also modified Exhibit D (Page D3) to clarify that these berms will <br />be the only permanent stockpiles located on the site. <br />6.4.7 EXHIBIT G - Water Information <br />17. Page 5 of Attachment G-1, the Groundwater Monitoring and Mitigation Plan states <br />once mining begins, monitoring will be conducted on a monthly to bi-monthly basis <br />until a quasi-steady state condition is reached. Please commit to monitoring the wells <br />on a monthly basis. <br />Attachment G-1 has been modified to commit to a monthly monitoring schedule. <br />18. In order to reduce the frequency of groundwater monitoring, Lafarge will need to <br />submit a Technical Revision to request this change with evidence to substantiate this <br />quasi steady-state condition is reached. <br />Noted <br />19. Please commit to obtaining an approved Substitute Water Supply Plan and a Well <br />Permit from the Office of the State Engineer prior to exposing groundwater at the <br />site. <br />Lafarge commits to this as stated on page G-3 of Exhibit G. <br />20. Please commit to submitting a copy of the Jones Ditch agreement prior to mining and <br />dewatering south of the Cache la Poudre River. Or if such an agreement cannot be <br />reached, Lafarge must submit and receive approval of a Technical Revision proving <br />that the mining/dewatering operation south of the Cache la Poudre River will not <br />impact the Jones Ditch. <br />As stated on page 7 of Attachment G-1, an agreement with the Jones Ditch will be in <br />place prior to dewatering and mining south of the Cache la Poudre River. We have <br />added language to this section that goes on to state that if an agreement cannot be <br />reached, Lafarge will first submit and receive approval of a Technical Revision <br />proving that the mining/dewatering operation south of the Cache la Poudre River will <br />not impact the Jones Ditch.
