Division of Reclamation, Mining, and Safety
1313 Sherman Street Room 215
Denver, Co. 80203
January 16, 2010
RE: TR 59
Dear Sandy, Marcia, and Dan:
?? ,? ?Q?Q uor,
We will withdraw our objection to TR 59. We do want it noted that I did read the policies by
Tri-State and they do not agree with the dilution. In fact, their policy is that dilution is not the
solution to pollution. They treat all of their ponds before the water is returned to the river. I
don't know who will be using the water down the way, but I guess that will be on your conscious
if there is something in the water that could hurt them or their animals.
We do want to tell all of you one more time that POND 11 is not staying on this property in our
Alfalfa field. That pond could have been built even on WFC that they bought from Johnsons and
done the same job. It did not have to be built there. It was built in a Prime farmland field and we
have said from the beginning that we do not want it there and we do not want it to be left there.
If there is anything in this Technical revision that allows any of that or has anything to do with
POND 11, we are not agreeing to that. Since we have never received a copy of TR59, we are
taking you at your word and we will withdraw our objection to TR59.
Thank you,
(g4 Q
,,?
