Box 46667 <br />Denver, Colorado 80201-6667 <br /> <br />CO-0026 <br />February 7, 2008 <br />Mr. Dan Mathews <br />Colorado Division of Reclamation, Mining & Safety <br />101 South Third Street, Suite 301 <br />Grand Junction, Colorado 81501 <br />RE: Potential section 7 Consultation, CAM Mining LLC "McClave Canyon" mine, Permit <br />C-1980-004, Technical Revision TR-16 <br />Dear Mr. Mathews: <br />This in response to the Colorado Division of Reclamation, Mining and Safety's January 3, 2008, <br />inquiry whether or not section 7 consultation with the U.S. Fish & Wildlife Service (USF&WS) <br />would be required for the above subject. <br />TR-16 proposes.to construct a new 38,000 cubic yard coal waste disposal site within the existing <br />permit area in the vicinity of an existing sediment pond and soil stockpiles. Approximately 4.75 <br />acres of new disturbance would occur involving the coal waste disposal site including the <br />relocation of the soil stockpiles and the replacement of the existing sediment pond with a new <br />sediment pond. <br />The USF&WS has previously determined that any water depletions in the Upper Colorado River <br />System "may affect / likely to adversely affect" the continued existence of the Colorado <br />pikeminnow, Oychocheilus Lucius), razorback.sucker QbEquchen texanus), boneytail Gila <br />ele ans , and humpback chub Gila cypha). Before the Office of.•Surface Mining Reclamation <br />and Enforcement (OSM) can determine whether or not formal section 7 consultation is <br />necessary, CAM Mining LLC must provide information regarding the evaporative loss of the <br />existing and new sediment pond. Should the evaporative loss be greater that previous <br />consultations, OSM would need to reinitiate consultation with the USF&WS. <br />In addition, previous threatened and endangered species surveys of the McClave Canyon permit <br />area did identify a small stretch of Munger Creek near, its. confluence with East Salt Creek with <br />suitable alluvial soils as potential habitat to support the threatened Uinta basin hookless cactus <br />(Sclerocactus glaucus). Before OSM can.determine whether.or not formal section 7 consultation <br />is necessary, CAM Mining LLC must provide habitat information for the Uinta basin hookless <br />cactus on the new disturbed and adjacent areas of the proposed new coal mine waste disposal <br />site. .. <br />:1, . <br />TAKE PRIDES <br />NRIGA?---w7;;!m?
