(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1982-098 <br />INSPECTION DATE: 1/13/10 INSPECTOR'S INITIALS: ECS_ <br />OBSERVATIONS <br />This was a routine monitoring inspection for the Beattie Pit #1, a Kit Carson County 110c sand and gravel <br />permit, conducted by Eric Scott of DRMS. DRMS traveled with Kit Carson Road and Bridge representative <br />Walt Isenbart to the site, and observed the site with him at approximately 1410. The permit sign was present <br />but in rather poor condition with some missing letters/numbers, and should be repaired. There were no permit <br />boundary markers present other than possibly the fence on the west and south side of the site. The sign will <br />need to be repaired and appropriate permit boundary markers placed to define the extent of the permit area. <br />Kit Carson County currently has 9.5acres permitted at this location. This is a currently active site. During the <br />inspection it was noted that the disturbed area would likely be very close in size to the permitted 9.5 acres, <br />although there were no boundary markers present for verification. The County will need to place boundary <br />markers as appropriate, and demonstrate to the Division that all mining activities (including topsoil stockpiles) <br />are within the permitted 9.5 acres. If the affected area is over 9.5 acres, this is a violation of the existing permit <br />and would require immediate corrective action in the form of a permit amendment or I I2c conversion to avoid <br />possible enforcement actions by the Mined Land Reclamation Board. If the disturbed area exceeds 9.5 acres, <br />the permit will need to be amended. If the disturbed area is greater than 9.9 acres the county will need to <br />convert this site to a 112c permit. <br />It was also observed that mining was taking place within 200' of the county road, and an overhead power line. <br />The County will need to obtain a damage waiver agreement for the road and with the power company for their <br />activities because they are within 200 feet of man-made structures as stated in section 6.3.12 of the rule.
