C-1981-008 <br />PR-06 PAR <br />22-Jan-2010 <br />Page 18 of 26 <br />extent of dryland pasture and irrigated pasture depicted on proposed Map 2.05.4-5 is <br />appropriate for the bond liability period (see "a" below). WFC must also demonstrate <br />that the affected lands will be restored to conditions that are capable of supporting the <br />uses which they were capable of supporting before any mining, pursuant to Rule 4.16.1 <br />(see "b" through "e" below). This requirement would apply to lands which may have <br />been infrequently or patchily irrigated prior to mining due to limited irrigation water <br />availability; if the landowner was able to apply some irrigation water to portions of the <br />land prior to mining, the same capability should exist after mining and following bond <br />release. Further clarification is needed as noted below. <br />a) Please provide documentation of NRCS concurrence with the assumptions that <br />are the basis for the acre/share ratio for postmine irrigated pastureland areas <br />seeded with Seedmix #5 (both sideroll irrigation and flood irrigation). Please <br />modify the current acre/share ratio projections if warranted based on NRCS <br />consultation, and revise the postmine acreages of irrigated pastureland and dryland <br />pastureland accordingly. <br />b) For the 38.97 acre Benson property north of BB Road and west of 2700 Road, <br />narrative in sub-section 2.0 of Section 2.05.4(2)(e) states that site grading would be <br />performed so that "irrigation water could be brought to the site in the future, if the owner <br />obtains these rights". <br />Please describe the existing and planned irrigation structures (i.e.) laterals, ditches <br />and pipes, etc. that would accommodate such future use. Please confirm and <br />describe in the narrative how site grading will allow for irrigation of a comparable <br />acreage to the area irrigated prior to mining, if the landowner does choose to <br />irrigate the property at some point after bond release. <br />c) For portions of the Lloyd parcel north of BB Road and west of 2700 Road that <br />were flood irrigated to some extent in the past but would be reclaimed to dryland <br />pasture under the PR-6 proposed plan, please confirm that site grading would allow <br />for irrigation of a similar nature and extent to that performed prior to mining if the <br />landowner chooses to do so after bond release, and describe the irrigation structures <br />that would accommodate such future use. <br />d) For the WFC parcels west of the Lloyd parcel that were flood irrigated to some <br />extent in the past but would be reclaimed to dryland pasture under the PR-6 <br />proposed plan, please confirm that site grading would allow for irrigation of a <br />similar nature and extent to that performed prior to mining if the landowner (or <br />future landowner) chooses to do so after bond release, and describe the irrigation <br />structures that would accommodate such future use. <br />e) For the WFC parcel in the extreme southeast corner of the permit area that was <br />flood irrigated to some extent in the past but would be reclaimed to dryland pasture <br />under the PR-6 proposed plan, please confirm that site grading would allow for <br />irrigation of a similar nature and extent to that performed prior to mining if the
