Preliminary Adequacy Review
Dear Mr. Gubka:
The New Horizon Mine permit was recently renewed with the issuance of RN-05 on the 3rd of
October 2009. By Stipulation No. 16, attached to the renewal, the Division of Reclamation,
Mining and Safety (the Division) required Western Fuels - Colorado (WFC) to submit a permit
revision application within 30 days. The permit revision application was to include
comprehensive amendments to the site description and land use, vegetation information, prime
farmland investigation, revegetation, postmining land uses, and prime farmlands sections of the
permit.
In response to Stipulation No 16, WFC submitted the PR-06 application on the 12`h of November
2009. The Division determined the application to be complete for purposes of filing on the 23`d
of November. The Public Notice appeared in the San Miguel Basin Forum on the 3'd, 10`h, 17t1i
and 24th of December 2009.
Written comments regarding the PR-06 application have been received from Jim Boyd, of the
NRCS; from landowners; and from numerous citizens. The public comment period extends 30
days from the fourth publication of the notice, and will close on Saturday, the 23`d of January
2010. The Division has transmitted copies of the comments received to WFC at regular intervals
throughout the public comment period. A list of the letters the Division received and has
transmitted is attached. Due to the level of public interest generated by PR-06, the Division will
be hosting an informal conference in Nucla on the 18th' of February 2010.
