III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br />and Safety. The mine is a reclaimed surface mine with a reclaimed load out just south of the town of <br />Walden. The weather was cold and foggy. The gate to the load out remains locked. The load out was <br />snow covered with 8-12 inches of snow. <br />Roads: The load access road was snow covered and drifted, and vehicle access was not attempted. The <br />Loadout was accessed using snow shoes. Another set of snow shoe tracks, footprints without snow <br />shoes, and dog prints were noted along the load out access road. <br />Hydrologic Balance: The load out pond was frozen, snow covered, and was not discharging and the <br />permanent pool of water. <br />Support facilities: There has been no new activity at the load out. No problems noted with the load out <br />pond or with the reclaimed load out area. <br />Wildlife: Numerous deer track were noted throughout the load out and load out access road. A large <br />Golden Eagle flushed from the Load out access road as the inspector was walking to the load out. <br />Although the load out was snow covered, there was evidence of wildlife browsing of the Rabbit Brush <br />shrubs that were exposed above the snow pack. <br />No problems were noted with the load out. <br />3 of 4 WHITE - File YELLOW - Operator PINK - Specialist
