EXHIBIT "O" <br />Owners of Affected Land (Surface Area) & <br />Owners of Substance to be Mined <br />The attached recorded deed indicates that LEN L. CAMP and ROXIE L. CAMP are the owners <br />of all the surface area and the substance to be mined. <br />As a general rule, where the surface of the land contains sand and gravel, a mineral reservation <br />does not include the sand and gravel. Keith v. Kinney, 140 P.3d 141, 149 (Colo. App. 2005); <br />Morrison v. Socolofsky, 43 Colo. App. 212, 214, 600 P.2d 121, 122 (1979). <br />There are 16 states whose courts refuse to give such a broad meaning to the word "minerals" as to <br />include the common rocks of the earth are Alabama, California, Colorado, Kentucky, Kansas, <br />Louisiana, Michigan, Mississippi, Missouri, New Mexico, North Dakota, Oklahoma, South <br />Dakota, Texas, West Virginia and Wyoming. <br />ADDRESS of SURFACE OWNERS: <br />LEN L.
