Cattany <br />Division Director <br />Natural Resource Trustee <br />Dear Mr. and Mrs. Steel: <br />The Division of Reclamation, Mining a Safety (Division) received your comment letter regarding the <br />Jesse Lee pit, Permit No. M-1984-043, on December 28, 2009. The Division investigated your concern <br />regarding the construction of a ditch instead of a berm and the location of the existing berm on the <br />improper side (south instead of north) of the ditch between the Jesse Lee pit and the Steel Ranch <br />property. <br />The Storm Water Management Plan (SWMP) issued by the Colorado Department of Public Health and <br />Environment for the Jesse Lee pit indicates overland flow from upland areas to the Mine Face and <br />sediment from adjacent properties will be controlled by diversionary channels. Therefore, the Jesse Lee <br />pit is in compliance with the approved Storm Water Management Plan. <br />The Division does not consider the construction of a ditch instead of a berm or the location of the berm <br />on the south side of the ditch to be a possible violation by Pelino, Inc. <br />If you have any questions, please contact Peter Hays at 303-866-3567 ext. 8124. <br />Sincerel <br />Peter S.
