III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator during the field inspection and records check.Most of the loadout was covered in snow. <br /> Sims and Markers <br /> The mine identification signs were up at the main entrance,east entrance and near the railroad tracks. All of the <br /> signs contained the required information. Permit boundary markers were up along the permit area boundary. <br /> Roads <br /> The paved haul road was in good condition and clear of any snow or ice.The guard rail was in place.There was <br /> no sign of coal dust being tracked onto the main highway from the loadout truck traffic. The east side graveled <br /> entrance road was partially snow covered but was passable.Also passable was the road along the tracks. <br /> Topsoil Stockpiles <br /> The east side topsoil stockpile was mostly covered in snow. The topsoil signs were up on the pile.The <br /> collection and diversion ditches were covered in snow. The west side topsoil stockpile was covered in snow on <br /> the north side but was clear of snow on the south side.Topsoil signs were up on this stockpile as well. <br /> Hydrology <br /> The east side sediment pond was covered in snow but there did not appear to be any standing water in the pond. <br /> The gated primary was closed. The pond embankment and emergency spillway were also covered in snow. The <br /> west side dugout pond was covered in snow as well. <br /> Most of the ditches were partially covered in snow but appeared to have sufficient capacity. Some of the inlets <br /> and outlets of the culverts were partially covered in snow but all appeared to be functional. The straw bales and <br /> silt fence along the railroad small area exemption area were partially covered in snow but were functional. <br /> Facilities <br /> There were no problems at the loadout office and parking area,the substation,the east side material storage area <br /> and the coal handling structures.There were no fuel leaks at the fuel facility. There was a small volume of <br /> stockpiled coal on the facilities bench.Railcars were being loaded during the inspection but coal haul trucks <br /> were not being unloaded. There were no problems with fugitive dust. <br /> Records <br /> The required loadout records were located at the loadout office,as documented on the attached records <br /> checklist. <br /> c:/word2007/terror/insp0110 <br />
