III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DBMS. Bill Bear represented the <br />operator. Snow covered most of the mine site, except for the south facing slopes. Mining is in the B-9 panel. <br />Main Mine Site <br />The road up to the utility bench had been plowed. The road's outside edge berm was in place, as was the <br />bench's outside edge berm. Most of the utility bench was covered in snow. The rock catchment berm above the <br />bench was in position. The cut and fill slopes appeared to be stable. There were no problems with the facilities. <br />There was only a little volume of coal that was stockpiled on the D-seam portal bench. Cut and fill slopes were <br />stable and the bench's outside edge berm was in place. There were no leaks at the fuel facility and there were no <br />problems with any of the structures and facilities, including the cap and powder houses. The material storage <br />areas were well organized. The main paved haul road was in good condition. <br />The cut and fill slopes at the B-seam portal bench were stable as well. The concrete wall on the outside edge of <br />the bench was in place. The excess material stockpile area across the haul road was stable. <br />The main topsoil stockpile was covered in snow. The topsoil signs were up. There was a moderate volume of <br />coal stockpiled on the main coal stockpile bench. The ice covered water level in pond B was at the primary <br />discharge level. The float was on the primary pipe and hose. <br />Coal Waste Stockpile Area <br />The road to the coal waste pile area had been graded of snow. The road berm was up. The ice covered water <br />level in pond C was up to the primary and will be discharged soon. Pond D only had some snow in it. The <br />ponds' discharge structures were functional. The operator was compacting coal waste on the second lift at the <br />coal waste pile. In addition, wet coal waste was being mixed with drier coal waste for eventual placement and <br />compaction on the pile. The south facing slopes of the coal waste pile were clear of snow but most of the rest of <br />the pile was covered in snow. The coal waste outslopes appeared to be stable. <br />Unit Train Loadout <br />A unit train was being loaded during the inspection. The loading operation was very clean since there was no <br />indication of any fugitive dust on the adjacent snow covered ground. The mine identification sign was up at the <br />entrance to the site. Ponds J and K were snow covered but did not appear to have any standing water in them. <br />The spur line bench outslopes were mostly free of snow and appeared to be stable. <br />Hubbard Creek Fan Site <br />The road up Hubbard Creek had been plowed. The entire fan site was covered in snow except for the entrance <br />road which had been plowed. The mine id sign was up at the entrance. Stream buffer zone signs on the opposite <br />side of the Hubbard Creek road had fallen off their posts and need to be put back up.
