Cattany <br />Division Director <br />Natural Resource Trustee <br />On the 21St of December 2009, The Division of Reclamation, Mining and Safety <br />("Division") received a letter signed by each of you, registering your objection to the <br />Division's proposed approval of Technical Revision No. 59 (TR-59) for the New Horizon <br />Mine permit. <br />The reasons for this objection are stated in the letter, as follows: <br />"I never received this Technical Revision and none of us have ever read it. We <br />do not know what it affects and if this concerns any of the Morgan property, we <br />are objecting until we have the time to review the Revision. We would like to <br />receive a copy for reviewing and until we do, we are objecting to its contents <br />and the approval of it. " <br />The Division understands that Western Fuels - Colorado ("Western Fuels") has <br />voluntarily agreed to provide Mr. Frank Morgan with copies of revision applications <br />when those proposed revisions will have a direct impact to the Morgan property. This <br />special arrangement has been made because of the unique reading/lighting conditions <br />required by Mr. Morgan, due to his failing eyesight. TR-59 addresses water sampling <br />and monitoring requirements for the New Horizon Mine, with no potential direct impacts <br />to Mr. Morgan's property.
