Thirdly, the narrative indicates that <br />"reclaimed block production as measured by the total harvest method must equal <br />or exceed 100% of the standard, with a 90% confidence interval". Because the <br />demonstration is based on total harvest data rather than a sample of the bond <br />release block production, reference to a specific confidence interval could create <br />confusion. If success is demonstrated by direct comparison of total harvest data <br />averages, the positive determination of revegetation success would by definition <br />me made "with not less than 90% level of confidence", and as such would comply <br />with Rule 4.25.5(3)(d). <br />Unless justification can be provided for an alternative approach, please re- <br />state the first paragraph of subsection 6.1.5 as follows: <br />Revegetation will be deemed adequate if the adjusted 3 year average <br />annual I' cutting alfalfa hay crop production (expressed in pounds per <br />acre) is equivalent to, or higher than, the average annual 1" cutting <br />production for the reference field (determined from an appropriate <br />minimum 3 yearperiod), based on direct comparison of the reclaimed and <br />reference site production averages. <br />Rule 2.05.5 Postmining Land Uses <br />20. Rule 2.05.5(1)(b) requires that the postmining land use plan be accompanied by a <br />copy of comments concerning the proposed use by owners of record. Although <br />the Division does not have authority to require landowners to provide comments <br />for inclusion in the application, it was agreed that for PR-6, WFC would provide <br />letters to the permit area landowners requesting their comments on the proposed <br />postmining land uses, and that copies of the letters would be included in the <br />application. In Attachment 2.05.4(2)(e)-8 "Correspondence with Landowners on <br />Post-mining Land Use Changes", the operator has included letters to WFC, Mr. <br />and Mrs. Frank Morgan, Mr. and Mrs. Bud Benson, and Mr. Harry Curtis Lloyd. <br />These letters represent only the subset of landowners with holdings west of 2700 <br />Road. <br />If landowner letters have been provided to or comments have been submitted <br />by landowners with holdings in the remainder of the permit area, please <br />provide documentation (or reference the permit sections where such <br />documentation is provided). Otherwise, please prepare and send <br />appropriate letters to the remaining landowners, and provide copies for <br />inclusion in Attachment 2.05.4(2)(e)-8. <br />21. The currently approved version of Map Exhibit 2.05.4-5 "Postmining <br />Vegetation/Land Use Map" includes depiction of existing and planned irrigation <br />infrastructure (laterals, ditches, pipes, sprinklers, etc.).
